  • This Privacy Notice (the “Privacy Notice”) governs the processing of personal data by YAN. The Privacy Notice does not cover any third-party websites, applications, software, products, or services that integrate with YAN.
  • Here YAN is acting as a data organizer and data processor: We may act either as a data organizer or a data processor. Our act depends on the specific situation in which personal data is handled by us, as explained in detail below:

Hence, we are the organizer when you send us an inquiry or sign a service, supplier contract, or employment contract with us.     • Our third-party vendors, OEMs, who provide us with cloud-based IT and business support, as well as customer care services, may need to process your information. All such third parties are operating under contract and acting on behalf of us.
    • Expert authorities. When required in response to a legal process or request from a competent authority according to applicable laws or in connection with a legal proceeding or process.
    • Mergers, acquisitions, or sale of assets. When required as part of a merger, acquisition, sale of assets (such as service agreements), or transition of service to a group entity or another company.

When our digital marketing activities utilize different third-party advertising platforms' features, we may board you by uploading your account information (e.g., a hashed email address or phone number) or advertising ID to such platform. Such third parties are operating under contract and acting on behalf of us and include data transfers to partners located in the India.

We will only retain your data as long as is necessary for the performance of the contract and as long as required by the provisions laid down by laws and regulations concerning the retention of the data. If we retain your data for purposes other than the performance of a contract, such as accounting and the fulfillment of the mandatory legal requirements, we will retain the data only if it is necessary for that purpose and/or provided for by law and regulations.

The scope of your rights and restrictions depends on the nature of the process and the legal basis. In order to verify the lawfulness of your request, we may ask you to provide us with an identifying piece of information that allows us to identify you in our system. We will answer your request within a reasonable time frame but no later than 45 days.

Submission of Data

Any data or information material you transmit to YAN through electronic mail, or the Website, or Mobile Applications or otherwise is unsolicited by YAN and is deemed non-confidential and non-proprietary until it is informed specifically to YAN. YAN is not responsible if any user submitted that is abusive, illegal, obscene, pornographic, threatening, disruptive, or otherwise improper. YAN has no liability or responsibility to you for the performance or nonperformance of such activities.

Indemnity

You agree to indemnify, defend, and hold harmless YAN, its officers, directors, employees, vendors, OEMs, suppliers, and agents, from and against all claims, losses, liabilities, costs, and damages of any nature whatsoever, including without limitation legal, accounting, and expert fees, arising out of or in any way connected with your use of YAN Websites and Mobile Applications or personal data you shared or your breach of the terms of this Agreement.
